While it may be the case that a prenup mentally opens the door to eventual divorce as an option — a place that engaged couples do not like to envision themselves — it can also be considered akin to a business deal. A prenuptial agreement must include a full disclosure of assets of each spouse-to-be.
In some cases, we will advise clients against signing a prenuptial agreement, and make sure that they understand the rights of a married person in Pennsylvania. For many others, however, we see how negotiating a prenup can be a sensible way to grapple with the financial realities of marriage. A prenup is essentially a contingency plan for division of property in the event of a failed marriage — perhaps analogous to a fire insurance policy on a house or a life insurance policy, both of which also create plans for dealing with unexpected misfortunes.
Taking out the emotional component of contemplating a possible divorce someday, our clients who elect to sign prenuptial agreements make decisions that help put their and their families' minds at ease. This may be especially true in cases such as the following:
- Second and third marriages
- Marriages when one or both spouses have children from previous relationships
- Marriage of a business owner, where the business partnership agreement stipulates that partners will protect their portion of the business through a prenup in the event of marriage
- Marriage between individuals with widely divergent assets and incomes
