While it may be the case that a prenup mentally opens the door to eventual divorce as an option — a place that engaged couples do not like to envision themselves — it can also be considered akin to a business deal. A prenuptial agreement must include a full disclosure of assets of each spouse-to-be.

In some cases, we will advise clients against signing a prenuptial agreement, and make sure that they understand the rights of a married person in Pennsylvania. For many others, however, we see how negotiating a prenup can be a sensible way to grapple with the financial realities of marriage. A prenup is essentially a contingency plan for division of property in the event of a failed marriage — perhaps analogous to a fire insurance policy on a house or a life insurance policy, both of which also create plans for dealing with unexpected misfortunes.
