Sometimes clients ask us about legal separation as an option when they are not sure whether — or when — to file for divorce. While legal separation is not allowed in Pennsylvania, there are other ways to divide and protect assets while remaining married. A post-nuptial agreement, if done properly, is a way that some couples separate their financial matters while going through counseling or when postponing divorce for any reason. The postnup works in much the same way that a prenuptial agreement does. Full disclosure of all assets is required in order for a prenup or postnup to be valid.
