Understanding Exclusive Possession
In many divorces, at least one spouse strongly wishes to live in the marital house while the divorce is pending. If both spouses want to stay, there is generally no problem as long as the couple can live together peacefully. But, if one spouse is abusive or is acting very irresponsibly, the other spouse can ask a family court judge to evict the misbehaving person.
The most common reason why one spouse seeks exclusive possession is that there is some form of domestic violence in the home. In these cases, the abused or threatened spouse can seek a Protection From Abuse (PFA) order, which is often enough to prove to a judge that the violent spouse should be forced to leave until the divorce is finalized.
There are a few additional factors that will be considered, such as:
- The level of conflict between the parties
- Whether a spouse can afford alternate housing
- How child custody will be affected
