Our Family Law Practice Areas
We handle the full spectrum of family law issues, including:
Contested and uncontested divorce: Pennsylvania has a no-fault divorce system, so you do not have to prove that your spouse wronged you in any way.
Child custody and visitation: We can help you forge a custody agreement that works for your family. We will give you guidance on issues like:
- Pennsylvania's new child custody law
- Custody issues arising when one parent wants to move out of state
- Custody for children with special needs
- Grandparents' rights
- Fathers' rights: In Pennsylvania, mothers do not necessarily have an advantage when child custody is being determined — even in the case of a nursing baby.
Child support: Pennsylvania has guidelines that determine the amount of support. We will help you present all relevant information to the court so the judge can make the right determination. We can also assist you in modifying child support if your financial circumstances change.
Complex asset distribution and property division: After children's issues, property division is often the most important part of a divorce. We can help you protect your assets and make sure you receive a fair share of marital property, like real estate, bank accounts, retirement accounts and other assets.
Spousal support and alimony: Whether you are seeking or paying spousal support, we can help ensure your fair treatment. We can answer important questions like, "Should I move out, and how will moving affect alimony payments?"
Marital agreements: We are available to draft and review prenuptial agreements and postnuptial agreements. These documents allow the couple to decide issues of property division between themselves rather than relying on a judge.
Children and youth: We handle a wide variety of cases involving abuse investigations conducted by the Pennsylvania Department of Public Welfare's Office of Children, Youth and Families (also known C&Y). We also represent clients in C&Y dependency hearings.
PFA and domestic violence: We are prepared to represent victims of domestic abuse and those accused of spousal abuse. We are familiar with all aspects of Protection from Abuse Orders (PFAs).
What About Cohabitation?
Although Pennsylvania has not legalized same-sex marriage and does not have "common law" marriage, many unmarried couples live together, sharing resources and household responsibilities.
While not technically a family law matter, the break-up of a cohabiting couple has to deal with many of the same issues that a divorcing couple does: division of property, child custody agreements and support questions when one domestic partner has been financially dependent on the other.
We do advise that any unmarried couples, gay or straight, create and sign cohabitation agreements before moving in together. We can also help separating domestic partners achieve equitable division of property and debts in an orderly manner, and address child custody problems.
